ARTICLE 1 – IDENTITY OF THE SELLER
These General Terms and Conditions of Sale (hereinafter “GTC”) are provided by SUB EXCELSUS, a limited liability company, registered with the Trade and Companies Register of Saint-Pierre under number 429 247 182, whose registered office is situated at 1 impasse des plongeurs, Z.A Pointe des Châteaux, 97436 Saint-Leu – Réunion.

ARTICLE 2 – PURPOSE AND SCOPE OF APPLICATION
These Terms and Conditions govern the sale of scuba diving services, sea trips, training courses, introductory dives, supervised explorations, guided snorkelling, as well as the sale of gift vouchers, offered by SUB EXCELSUS.
Any booking or order implies full and unconditional acceptance of these Terms and Conditions.
ARTICLE 3 – CONDITIONS OF ACCESS TO SERVICES
Participation in activities is subject to:
- the customer’s medical fitness to practise diving (health questionnaire and/or medical certificate in accordance with current regulations),
 
- compliance with technical prerequisites and required levels,
 
 - strict adherence to safety instructions and decisions made by the instructors.
 
SUB EXCELSUS reserves the right to refuse or interrupt a service if safety or fitness conditions are not met, without this giving rise to any right to compensation.

ARTICLE 4 – ORDERS, BOOKINGS AND PAYMENT
Bookings can be made online via the website or directly with the centre.
For first-time participation in an activity offered by SUB EXCELSUS, full prepayment of the service is required in order to confirm the booking.
For customers already known to the centre, full or partial payment may be requested depending on the service booked.
The booking becomes firm upon written confirmation by SUB EXCELSUS and receipt of payment.

 

ARTICLE 5 – PRICES AND PAYMENT TERMS
Prices are quoted in euros, inclusive of VAT.
The following payment methods are accepted: credit card, bank transfer, cheque and cash on arrival.

ARTICLE 6 – CANCELLATION, POSTPONEMENT AND WEATHER CONDITIONS
Cancellation by the customer
All cancellations must be notified in writing (by email or message).
Cancellation more than 24 hours before the service: refund or postponement possible.
 
 Cancellation less than 24 hours before the service, no-show on the day of the activity or late arrival preventing participation: no refund will be given.
 
Cancellation or modification by SUB EXCELSUS
In the event of adverse weather conditions, safety constraints, force majeure or a decision by the Dive Director, SUB EXCELSUS reserves the right to cancel or postpone the service.
In this case, the customer may choose between postponing the service or a refund of the sums paid, without any further compensation.

 

ARTICLE 7 – RIGHT OF WITHDRAWAL
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to leisure services provided on a specific date or at specific intervals, in particular scuba diving activities.
Any confirmed booking is therefore final, subject to the cancellation conditions set out in Article 6.

ARTICLE 8 – LIABILITY AND INSURANCE
SUB EXCELSUS holds professional liability insurance covering all the activities offered.
The customer certifies that the information provided regarding their state of health is accurate and acknowledges that they are solely liable for any failure to comply with safety instructions.

 

ARTICLE 9 – GIFT VOUCHERS
Gift vouchers purchased on the SUB EXCELSUS website are valid for one (1) year from the date of issue.
They are transferable to another person and may be used for an activity other than that originally intended.
If the price of the chosen service exceeds the value of the gift voucher, an additional payment will be required. No refund will be made if the value of the gift voucher exceeds the price of the chosen service.
Gift vouchers are neither refundable nor exchangeable for cash.

 

ARTICLE 10 – PERSONAL DATA
Personal data collected is processed in accordance with the General Data Protection Regulation (GDPR). Full details are set out in the Privacy Policy available on the website.

 

ARTICLE 11 – MEDIATION AND APPLICABLE LAW
These T&Cs are governed by French law.
In accordance with Articles L612-1 et seq. of the French Consumer Code, the consumer may, free of charge, refer the matter to a consumer mediator in the event of an unresolved dispute.
